A man could be jailed, even hanged, for stealing another man's horse, but not even reproached for beating his wife. (Miriam Grace Monfredo, Through a (...) Gold Eagle) Miriam Grace Monfredo's feminist genre fiction, her "historymystery " series featuring nineteenth-century librarian Glynis Tryon, offers an opportunity to find a way ofreading literary texts that is not only feminist, but also Girardian. Girard's work provides two clear ways to construct feminist readings directly, without the mediation of overtly feminist theory. First ofthese is Girard's respect for the "quasi-theoretical" potential of literary texts, especially some of those which attend to apparently trivial matters. In Deceit, Desire and the Novel, Girard argues that (male) novelists offer insights unavailable elsewhere, including those scientific fields that claim to know more than everyone else. In its valuing of questions about snobbism, for example, Deceit, Desire and the Novel offers a woman-friendly model. The (male) novelist's question about snobbism is "too frivolous" for (men of) science, but Girard argues that "in his probe of snobbism the novelist is asking himself in his own way just what Rosemary Erickson Johnsen59 might be the hidden springs that make the social mechanism tick" (220). While I regret the fact that Girard's examples and language often ignore women, I believe his conviction that attention to matters socially coded as superficial and frivolous can produce great insight is one feminist critics can appreciate. The second Girardian tool feminists can rely upon is the method of reading texts of persecution described in The Scapegoat. Girard suggests how we might read texts ofpersecution written by naive persecutors in ways that identify with the persecuted and gather the information unintentionally supplied by the authors: "I call those persecutors naive who are still convinced that they are right and who are not so mistrustful as to cover up or censor the fundamental characteristics of their persecution. Such characteristics are either clearly apparent in the text and are directly revealing or they remain hidden and reveal indirectly" (8). Monfredo's crime novels, set in the mid-nineteenth century and focusing on such disenfranchised groups of citizens as women, slaves, Native Americans, and free African-Americans, depend for their verisimilitude on her ability to read historical sources and literary predecessors in just such a way. Accuracy requires that Monfredo's works be categorized as feminist historical crime novels, however awkward such a lengthy description may be. Her novels observe the principles not only of both genres—historical fiction and detective fiction—but also the political position offeminism, and they meet these multiple demands with considerable skill. Furthermore, resolution in crime fiction depends upon the law; working within that tradition, Monfredo is called upon to seek solutions within the system, to look for justice as the result ofa proper functioning ofthe legal and social systems. Information gathered, whether by the official representatives ofthe law or by amateurs, is turned over to the authorities. While her novels clearly respect that tradition, they also point out some limits to the judicial system's ability to contain violence. Girard's model ofits functioning, as described in Violence and the Sacred, depends upon an equality that whole segments of the society Monfredo is depicting do not in fact enjoy: "The judicial authority is beholden to no one. It is thus at the disposal ofeveryone" (23). Ifwomen cannot own property, enter into contracts or sit on juries, in what sense is the law at their disposal? Monfredo's exploration ofthis question takes its place alongside Girard's explanation of the legal system's proper functioning; ifhis theory reveals how it works when all are enfranchised, her fiction suggests some ofthe consequences that result from the existence of disenfranchised subjects. 60'Seneca Falls Inheritance' Our Seneca Falls Inheritance In her first book, Seneca Falls Inheritance (1992), Monfredo offers a theory for the reduction of violence against women: provide women with complete legal equality. Notre intention est de tirer parti de nos propres expériences collectives de pratiques de recherche et d’enseignement pour cartographier comment et pourquoi nous avons d’abord (...) été interpellés par les nombreuses significations associées à ce terme et comment notre compréhension a changé au cours des quelque 25 dernières années. Americans increasingly cite moral values as a factor in how they vote, but when we define morality simply in terms of a voter's position on gay marriage and abortion, we lose sight of the ethical decisions that guide our everyday lives. In our encounters with friends, family members, nature, and nonhuman creatures, we practice a nonutilitarian morality that makes sacrifice a rational and reasonable choice. Recognizing these everyday ethics, Anna L. Peterson argues, helps us move past the seemingly irreconcilable (...) conflicts of culture and refocus on issues that affect real social change. Peterson begins by divining a "second language" for personal and political values, a vocabulary derived from the loving and mutually beneficial relationships of daily life. Even if our interactions with others are fleeting and fragmentary, they provide a viable alternative to the contractual and atomistic attitudes of mainstream culture. Everyday ethics point toward a more just, humane, and sustainable society, and to acknowledge moments of grace in our daily encounters is to realize a different way of relating to people and nonhuman nature—an alternative ethic to cynicism and rank consumerism. In redefining the parameters of morality, Peterson enables us to make fundamental problems such as the distribution of wealth, the use of public land and natural resources, labor and employment policy, and the character of political institutions the preferred focus of debate and action. Héritiers du modèle républicain, les musées ont été introduits dans les colonies françaises par le biais de l’Institut français d’Afrique noire au cours des années 1930. Ils répondaient à des impératifs politiques et idéologiques précis, à savoir, instituer des valeurs idéales grâce auxquelles fédérer des groupes humains hétérogènes. Ernst Wiechert’s prose written in the 1930s is best symbolized by Friedrich Hölderlin’s poem "Abendphantasie", in which the persona describes his loneliness and resignation, describing them as a thorn in his chest. The question of the identification of these feelings with the East Prussian writer is a major problem raised in the article. Wiechert certainly belongs to the group of writers associated with the so called Inner Emigration, and the studies by Herbert Wiesner, Ralf Schnell, Reinhold Grimm and Friedrich Denka (...) support this thesis. Also, the method developed by Hubert Orlowski allows us to include or exclude literary works from inner emigration literature. This method turns out to be helpful in the interpretation of Wiechert’s works. Moreover, the question of Wiechert’s position on National Socialism is considered, which is full of contradictions, as well as his coming close to the Inner Emigration. On the basis of selected prose works created in the 1930s, the writer’s evolution from the ‘breakthrough of grace’ to becoming an inner emigrant will be presented. Particularly noteworthy are some relevant themes in his works such as World War I, the mother figure as a prefiguration of the ‘Great Mother’ myth, the writer’s stand on National Socialism or the Mazurian landscape. This paper considers the questions that Badiou's theory poses to the culture of economic managerialism within education. His argument that radical change is possible, for people and the situations they inhabit, provides a stark challenge to the stifling nature of much current educational debate. In Saint Paul: The Foundation of Universalism, Badiou describes the current universalism of capitalism, monetary homogeneity and the rule of the count. Badiou argues that the politics of identity are all too easily subsumed by the prerogatives (...) of the marketplace and unable to present, therefore, a critique of the status quo. These processes are, he argues, without the potential for truth. What are the implications of Badiou's claim that education is the arranging of ‘the forms of knowledge in such a way that truth may come to pierce a hole in them’ (Badiou, 2005, p. 9)? I will argue that Badiou's theory opens up space for a kind of thinking about education that resists its colonisation by the cultures of management and marketisation and leads educationalists to consider the emancipatory potential of education in a refreshing new light. Le libertinage est un phénomène hétérogène qui se caractérise par plusieurs attitudes de pensée et de mœurs. La contestation des valeurs chrétiennes est un élément commun liant toutes les formes du libertinage. Le libertinage érudit qui se caractérise par le naturalisme et le scepticisme au regard de toutes vérités universelles est une des variétés caractéristiques du libertinage au XVIe et au XVIIe siècles. Il associait les hommes de lettres, les hommes de sciences, les fonctionnaires publics cependant il ne constituait pas (...) un système homogène. Aussi des personnages associés au libertinage érudit ne créèrent aucun groupe formel et aucune association. Le libertinage de mœurs se développait simultanément au courant du libertinage érudit. L'œuvre de P. Gassendi avait une influence sur le développement de ce courant. Le libertinage de mœurs est très connu et répandu grâce aux histoires amoureuses, aux flirts et aux scandales amoureux. Cependant il serait faux de définir et de déterminer le phénomène de tout le libertinage uniquement en catégories de la liberté de mœurs et du relâchement des mæurs. Sans aucun doute le libertinage de mœurs contribua au changement du statut social, de l'identité sexuelle et culturelle des femmes. Celles qui se trouvaient dans les chaînes du mariage, ne possédant pas de liberté de l'activité publique ni politique commencèrent à apercevoir la possibilité de s'activer et de se libérer de l'espace privé. La matérialité et la sensualité ne se développèrent pas uniquement sous l'influence de la relativisation des mœurs mais aussi, comme le prouva M. Foucault, grâce aux «livres de bonne confession». Le catalogue des fautes et des péchés concernant la sphère sexuelle qui y furent inscrits était de plus en plus détaillé. Cela résultait de nouvelles doutes des croyants en question de la nature du péché. Ainsi ces livres devinrent un type de guide de la sphère sensuelle. Les œuvres du marquis de œade sont les plus controversées en matière du libertinage de mœurs. L'évaluation de ses œuvres comprend en soi la condamnation des œuvres ainsi que du style de vie du marquis de œade, les accusations, l'immoralisme et le blasphème, la cruauté et la violence. Les champs de recherche et d'interprétation essaient d'analyser ses œuvres aussi en référence au problème des limites de la liberté de l’homme, sa solitude; elles sont aussi interprétées en tant que «philosophie du crime». Parmi plusieurs théories qui traitent le problématique du libertinage, il est apparu celle qui cherche des relations entre son développement et la croissance de la résistance par rapport à l'absolutisme depuis le XVIIe siècle. Cela devrait être lié à l'inquiétude du pouvoir public due à la liberté excessive de mœurs. Du point de vue du pouvoir public, le danger était constitué par le caractère privé et l'intimité - les situations où dans un groupe des personnes fidèles, sans présence des tierces personnes, s'effectuerait le changement de pensée, d'idées probablement dangereuses pour l'ordre public; par conséquent des contrôles officiels plus fréquents eurent lieu. Le libertinage de l'époque de la Renaissance modifia sa forme et son caractère. Au XVIIIe siècle toute la mosaїque et la diversification des formes du libertinage de mœurs sous l'influence de la monotonie ennuyeuse croissante, de l'atmosphère de l'inquiétude et du pressentiment de l'aube de l'époque, souvent s'exprima en lassitude décadente, fatigue, poursuite des divertissements. Le désespoir et les doutes emparèrent des intellectuels et des philosophes de la Renaissance; la libérer l’homme de toutes les contraintes égalment celles qui sont proclamées par le christianisme. Dans ce contexte le phénomène du libertinage cessa de remplir la fonction de la proposition du style de vie innovant même si souvent controversé qui en matière de mœurs fut même scandaleux, ainsi que de la manière à participer à l'ordre culturelle et de civilisation. Ce fut l'un des symptômes de la crise des valeurs de la Renaissance et la prémisse de l'atmosphère pessimiste. (shrink)

Trope theory is the view that the world is a world of abstract particular qualities. But if all there is are tropes, how do we account for the truth of propositions ostensibly made true by some concrete particular? A common answer is that concrete particulars are nothing but tropes in compresence. This answer seems vulnerable to an argument (first presented by F. H. Bradley) according to which any attempt to account for the nature of relations will end up either in (...) contradiction, nonsense, or will lead to a vicious infinite regress. I investigate Bradley’s argument and claim that it fails to prove what it sets out to. It fails, I argue, because it does not take all the different ways in which relation and relata may depend on one another into account. If relations are entities that are distinct from yet essentially dependent upon their relata, the Bradleyan problem is solved. We are then free to say that tropes in compresence are what make true propositions ostensibly made true by concrete particulars. (shrink)

The question of the unity of consciousness is often treated as the question of how different conscious experiences are related to each other in order to be unified. Many contemporary views on the unity of consciousness are based on this bottom-up approach. In this paper I explore an alternative, top-down approach, according to which (to a first approximation) a subject undergoes one single conscious experience at a time. From this perspective, the problem of unity of consciousness becomes rather the problem (...) of how we can distinguish a multiplicity of goings-on within our conscious experience at any time, given that it is unique. I will present three possible top-down approaches to unity of consciousness, which I call Priority unity monism, Existence unity monism, and Brentanian unity monism. Priority monism and Existence monism are defined in analogy with the homonymous metaphysical theories of object constitution. Brentanian monism retraces Franz Brentano’s view on unity of consciousness, and is defined by appeal to some of his mereological ideas. I will argue that the latter is the best top-down approach to unity of consciousness. (shrink)

The aim of this study is to explore the relationship between affectivity and moral experience from a phenomenological perspective. I will start by showing how in a phenomenologically oriented account emotions can be conceived as intentional evaluative feelings which play a role in both moral epistemology and the motivation of moral behaviour. I will then move to discuss a particular kind of affect, "existential feelings" (Ratcliffe in Journal of Consciousness Studies 12(8–10), 43–60, 2005, 2008), which has not been considered so (...) far in the discourse on moral and affective experience. Relying on the notion of pre-intentionality through which Ratcliffe characterizes existential feelings (Inquiry: An Interdisciplinary Journal of Philosophy 53(6), 602–626, 2010) and on some insights into the relationship between affectivity and ethics developed by De Monticelli (2003, 2006), I suggest that key to the role played by existential feelings in moral experience is that they determine the kinds of evaluations that it is possible for us to make and the range of our possibilities of action. I then illustrate and further develop this idea through a phenomenological analysis of some forms of psychopathological experience. More specifically, by considering some experiential features of depression and borderline personality disorder, I claim that, by acquiring an existential character, emotions such as guilt, feelings of isolation, anger and shame can radically alter the structure of the individual evaluative perspective, having a deep impact on both moral judgements and behaviours. According to the restructuring hypothesis, insight problem solving typically progresses through consecutive stages of search, impasse, insight, and search again for someone, who solves the task. The order of these stages was determined through self-reports of problem solvers and has never been verified behaviorally. We asked whether individual analysis of problem solving attempts of participants revealed the same order of problem solving stages as defined by the theory and whether their subjective feelings corresponded to the problem solving stages they were (...) in. Our participants tried to solve the Five-Square problem in an online task, while we recorded the time and trajectory of their stick movements. After the task they were asked about their feelings related to insight and some of them also had the possibility of reporting impasse while working on the task. We found that the majority of participants did not follow the classic four-stage model of insight, but had more complex sequences of problem solving stages, with search and impasse recurring several times. This means that the classic four-stage model is not sufficient to describe variability on the individual level. We revised the classic model and we provide a new model that can generate all sequences found. Solvers reported insight more often than non-solvers and non-solvers reported impasse more often than solvers, as expected; but participants did not report impasse more often during behaviorally defined impasse stages than during other stages. This shows that impasse reports might be unreliable indicators of impasse. Our study highlights the importance of individual analysis of problem solving behavior to verify insight theory. (shrink)

There is an ongoing debate in the metaphysics of dispositions regarding which type of modality governs their manifestation. This paper assumes as its default position the view that dispositions manifest by conditional necessity; that is, when in appropriate circumstances dispositions manifest necessarily. From this standpoint, the paper engages critically with an existing alternative in the literature, put forward most prominently by Mumford and Anjum, and known as dispositional modality. According to this latter view, even when in appropriate manifestation conditions, dispositions (...) only merely tend towards their manifestation. By raising difficulties for this alternative, the paper offers indirect support for the conditional necessity view. (shrink)

Wie verändern sich Mensch und Körper durch Technik? Und welches Menschenverständnis vertritt der Transhumanismus? Anna Puzio befasst sich in der ersten philosophischen Studie zur Anthropologie des Transhumanismus mit führenden Personen des Feldes, u. a. mit Nick Bostrom, David Pearce und Natasha Vita-More. Neben Körperoptimierung und Medizintechnologien beleuchtet sie auch Alltagstechnologien wie Wearables. Dabei entwickelt sie einen neuen Ansatz zur Technikanthropologie und ein neues inklusives Menschen- und Körperverständnis im Anschluss an Donna Haraway und den Kritischen Posthumanismus im amerikanischen Raum.

A co-actor’s intentionality has been suggested to be a key modulating factor for joint action effects like the joint Simon effect (JSE). However, in previous studies intentionality has often been confounded with agency defined as perceiving the initiator of an action as being the causal source of the action. The aim of the present study was to disentangle the role of agency and intentionality as modulating factors of the JSE. In Experiment 1, participants performed a joint go/nogo Simon task next (...) to a co-actor who either intentionally controlled a response button with own finger movements (agency+/intentionality+) or who passively placed the hand on a response button that moved up and down on its own as triggered by computer signals (agency-/intentionality-). In Experiment 2, we included a condition in which participants believed that the co-actor intentionally controlled the response button with a Brain-Computer Interface while placing the response finger clearly besides the response button, so that the causal relationship between agent and action effect was perceptually disrupted (agency-/intentionality+). As a control condition, the response button was computer controlled while the co-actor placed the response finger besides the response button (agency-/intentionality-). We observed a JSE when the co-actor responded intentionally and the causal relationship between co-actor and action effect could be perceived, but not when the co-actor did not respond intentionally and the causal relationship was disrupted (Experiment 1). When the intentionality of the co-actor was maintained but the perception of the causal relationship between co-actor and action effect destroyed, the JSE was absent (Experiment 2). Our findings clearly indicate a vital role of a co-actor’s agency for the JSE and suggest that the ascription of agency is strongly perceptually grounded. (shrink)

Intrauterine insemination is one of many treatments provided to infertility patients. Many factors such as, but not limited to, quality of semen, the age of a woman, and reproductive hormone levels contribute to infertility. Therefore, the aim of our study is to establish a statistical probability concerning the prediction of which groups of patients have a very good or poor prognosis for pregnancy after IUI insemination. For that purpose, we compare the results of two analyses: Cluster Analysis and Kohonen Neural (...) Networks. The k-means algorithm from the clustering methods was the best to use for selecting patients with a good prognosis but the Kohonen Neural Networks was better for selecting groups of patients with the lowest chances for pregnancy. The idea that verbal communication involves a species of mindreading is not new. Among linguists and philosophers, largely as a result of Grice’s (1957, 1967) influence, it has long been recognized that the act of communicating involves on the part of the communicator and the addressee mutual metarepresentations of each others’ mental states. In psychology, the coordination of common ground and attention in conversation has been pursued in a variety of studies (e.g. Clark and Marshall, 1981; Bruner, 1983).

Federal policies on human subjects research have undergone a progressive transformation. In the early decades of the twentieth century, federal policies largely relied on the discretion of investigators to decide when and how to conduct research. This approach gradually gave way to policies that augmented investigator discretion with externally imposed protections. We may now be entering an era of even more stringent external protections. Whether the new policies effectively absolve investigators of personal responsibility for conducting ethical research, and whether it (...) is wise to do so, remains to be seen. (shrink)

Technology has developed to the point where a clear distinction between nature and culture seems to be dissolving. Against this background, a broad aspect of social research has emerged that considers an interdependence between the social and the material. So far, social-systems cybernetics as described by Luhmann has remained rather marginalized in these discussions. This article is intended to overcome this marginalization by developing the concept of meaning. Meaning can abstractly be defined as a ‘doing negativity’. Returning to systems theory, (...) it becomes obvious that verbalized meaning is only one possible medium of meaning. Adopting some concepts from Helmuth Plessner, I introduce another medium of meaning – corporealized meaning, which also operates meaningfully along the distinction between actuality and potentiality, and thus does negativity. I discuss consequences of observing the relationship between sociality and materiality from this perspective. (shrink)

Definition of the problemThe medical-ethical principle of beneficence is directed towards the well-being of patients. In clinical practice, the focus is often on the relief of pain, the elimination of symptoms and the restoration of bodily functioning. However, the significance of these health-related aspects for the overall well-being of patients also depends on individual values, desires, and life plans.ArgumentationAn overemphasis on the subjective perspective of patients on their well-being would admittedly lead to a strong substantial convergence of the two medical-ethical (...) principles of beneficence and respect for autonomy. In addition, it would not be compatible with some of the guiding principles of the medical profession. A mere objective perspective on patient well-being conversely carries the danger of imposing values on individual patients that they do not share. Consequently, actions that are intended to benefit patients instead harm them.ConclusionThrough a more detailed analysis of the relationship between health-related and overall well-being, this paper shows that health is only a relative value in our overall well-being. Basic health-related goods like a sound cardiovascular system or fully functioning lungs have special standing because they are seen as valuable independently of individual preferences and life plans, which means they are of objective value. According to the contemporary consensus, when reaching in the lexicon grammar looks for items like nouns, verbs, and prepositions while logic sees items like predicates, connectives, and quantifiers. In fact, there doesn’t seem to be a single lexical category contemporary grammar and logic both make use of. I hope to show that while a perfect match between the lexical categories of grammar and logic is impossible there can be a substantial overlap. I propose semantic definitions for all the major parts (...) of speech. I argue that the differences among these categories can be captured in terms of distinctions recognized in logic. (shrink)

If lay theories associate moral intuitions with deeply held values, people should feel uncomfortable relying on deliberative thinking when judging violations of personal taboos. In two preliminary studies, participants with siblings of the opposite sex were particularly troubled when evaluating a sibling incest scenario under instructions to think slowly and rationally, or when the scenario was presented in a hard-to-read font forcing them to employ deliberative processing. This suggests that we may be intuitive intuitionists, and opens the door for investigations (...) of people’s preferred modes of moral judgment. (shrink)

ABSTRACT In this survey we have investigated the experiences and attitudes of Danish physicians regarding end‐of life decisions. Most respondents have made decisions that involve hastening the death of a patient, and almost all find it acceptable to do so. Such decisions are made more often, and considered ethically more acceptable, with the informed consent of the patient than without. But both non‐resuscitation decisions, and decisions to provide pain relief in doses that will shorten the patient's life, have been made (...) and found acceptable by at least 50% of the respondents, even when there is no informed consent. Furthermore, 12% have doubled morphine dosages with fixed intervals, thus providing doses substantially higher than that necessary to control pain, without the informed consent of the patient. Two per cent have helped in assisted suicide, and 5% have administered a lethal injection at the patient's request. Respectively 37% and 34% find these last two practices ethically acceptable. Amongst those that do not find them acceptable, the most important reasons to be opposed are, the doctrine of double effect, the doctrine of doing and allowing, and the view that human life is sacred. Amongst supporters, the most important reasons mentioned are, that the patient's right to self‐determination should be respected, the view that a patient should not be forced to suffer, and the view that the patient has a right to be helped to a dignified death. The aim of the eugenics movement in the United States during the first half of the twentieth century was to prevent the degeneration of the white race. A central tactic of the movement was the involuntary sterilization of people labeled as feebleminded. An analysis of the practice of eugenic sterilization provides insight into how the concepts of gender, race, class, and dislability are fundamentally intertwined. I argue that in the early twentieth century, the concept of feeblemindedness came to operate as (...) an umbrella concept that linked off-white ethnicity, poverty, and gendered conceptions of lack of moral character together and that feeblemindedness thus understood functioned as the signifier of tainted whiteness. In March 1986, a public symposium took place in Heidelberg about the “unresolved potential dangers of genetic engineering”. The event was organized by institutions affiliated with the environmental movement. Choosing this symposium as an example, the article shows how the public appearance of scientists can be understood as a form of political activism. The article shows how specialists from fields as diverse as biology, chemistry, physics, law and political sciences tried to place political messages by putting themselves in the limelight (...) as independent scientists. I argue that the symposium was both: a place of science communication intertwined with political agitation that, as should be noted, happened in a time when the West German government was working on the legislation of genetic engineering, legitimated by relying on independent expertise. It can be concluded that the discourse of scientific independence became a strategic tool in the controversial debate about the uses and dangers of genetic engineering. Thus, it draws attention to a dimension of political-scientific activity which cannot be fully grasped by the concept of ‘the expert’ that is established in the history of science. (shrink)

The paper questions the view that the alleged lack of autonomy displayed by certain practices and cultural behavior may constitute a sound justification for limiting toleration of those practices. Not only is the concept of autonomy open to endless controversy, but it also entails a conflict with liberal public morality and often nurtures double standards. To this end, the paper first examines the assumptions and basis of the lack-of-autonomy approach; this analysis perforce leads the author to unravel the notion of (...) autonomy and its rival conceptions. Second, it will be argued that liberal and democratic politics, though indebted to the value of personal autonomy in a fashion, requires only a purely political principle of autonomy. It is also contended that if comprehensive notions of autonomy are used instead of a purely political conception, unacceptable consequences for the public morality of liberal democracy may follow. Finally, the point will be illustrated with some examples drawn from multicultural politics. (shrink)
